The Peruvian legislature has passed a measure making internet gambling and sports wagering legal, creating a new regulatory structure for these industries.
The legislation was approved following a discussion in the legislature on July 15th, with 91 votes in favor and none opposed.
The bill empowers the Peruvian Ministry of Foreign Trade and Tourism (Mincetur) to enforce the law, which also serves as Peru’s foreign trade agency.
Gambling taxes will be set at 12% of each operator’s taxable income, which is net earnings minus operational expenses, and will be collected on a monthly basis.
A maintenance tax will be levied at 2% of the operator’s monthly income.
The Peruvian tax agency Sunat will oversee the collection of taxes.
Operators with valid licenses will be permitted to offer bonuses for online games, but bonuses cannot be exchanged for cash.
For sports wagering, operators must display a cautionary message on all their platforms stating: “Excessive online sports betting can lead to problematic gambling.”
The law also permits the establishment of remote sports betting facilities, where players can utilize betting terminals to place bets on sporting events.
For breaches of this law, minor infractions may result in warnings and penalties of up to SOL200 (approximately £42).
A permit can be withdrawn for a maximum of ten years or indefinitely. The Peruvian Department of Tourism may also temporarily shut down operations and seize possessions. This new regulation comes into force sixty days after its publication in the Peruvian publication.
